Terms and Conditions for the Destination App

1. Acceptance of Terms

By accessing and using the services provided by the Destination App (referred to as "the App" hereafter), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. Definitions

·    "Partner" refers to a business or entity involved in the advertising of their business via the App.

·    "App" refers to the Destination High Street App.

·    “Member" refers to any individual or entity using the App.

·    "Service" refers to the functions tools and features provided by the App to Retailers.

3. Account Registration/Profile Management

·    Partners must provide accurate and complete information when creating a profile on the App.

·    Partners are responsible for maintaining accuracy of the listing and the App accepts no responsibility or liability for inaccurate or false information.

·    Partners are responsible for notifying the App of any changes in their profile or business that could lead to sales under false pretences.

·    The App is responsible for the accurate and timely input of the data.

·    On registration, Partners commit to subscription to the App for a minimum period of 6 months.

 

4. Use of Services

 

·    Partners agree to use the App solely for lawful purposes and in accordance with these Terms and Conditions.

·    Partners shall not use the App in any manner that could damage, disable, overburden, or impair the App's servers or networks.

·    Partners are responsible for all data, information, and content uploaded or transmitted through the App and are required to comply with all applicable laws and regulations.

·    Partners agree that any offers put through the App must be exclusive to Destination Bromsgrove members and not advertised elsewhere at the same time.

 

5. Payments and Fees

·    Partners will not be charged a monthly subscription in the until further notice for the prescribed services.

·    The App reserves the right to change its pricing structure and fees at any time. Updated fees will apply to future use of the services.

·    The app agrees to give 28 days’ notice of any changes in their tariffs or service levels.

·    If the app decides to implement charges all partners with have the right to cancel their subscription to the app with no cost implications.

  

6. Data Privacy

·    The App may collect and process personal and business information. The use of this data is subject to our Privacy Policy.

·    Partners consent to the collection, use, and disclosure of their information in accordance with our Privacy Policy.

 

7. Intellectual Property

·    The App and its content, including, but not limited to, logos, text, graphics and software are protected by copyright and other intellectual property laws.

·    Partners may not reproduce, modify, distribute, or create derivative works from any part of the App without explicit written consent.

 

8. Use of Destination Bromsgrove official communications

·    The Partners agree to only use the official provided point of sale and communications when advertising the App physically or digitally.

·    Failure to do so, or use of other literature to advertise Destination Bromsgrove will be seen as a breach of contract.

·    Destination Bromsgrove agrees to provide regular, and sufficient, communications for the Partner to effectively promote the App to their customers via social media, physically in store or digitally.

 

9. Warranty and Liability

·    The App is provided "as is" without any warranty. We do not guarantee the accuracy, completeness, or reliability of the services.

·    In no event shall the App be liable for any indirect, consequential, or punitive damages arising from the use of our services.

 

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

 

11. Changes to Terms

The App reserves the right to modify or replace these Terms and Conditions at any time. Changes will be effective immediately upon posting. Continued use of the App constitutes acceptance of the updated terms.
